Buying Art:

Payment:

Payment is required in full before artwork is delivered or shipped. Accepted payment methods include [Mastercard/Visa Credit/Debit cards and bank payment].

All artwork and title remains with Robert Perera Fine Art Ltd. until full cleared payment has been received

Shipping and Delivery:

Shipping costs are the responsibility of the buyer and will be added to the purchase price. Estimated delivery times will be communicated to the buyer, but delays may occur. International buyers are responsible for any customs fees or import duties.

Copyright and Reproduction:

The artist retains all copyright and reproduction rights to the artwork. Buyers may not reproduce, copy, or use the artwork for commercial purposes without written permission.

Privacy and Data:Personal information collected for transactions will be kept confidential. Information will only be used for order processing and will not be shared with third parties.

Damage or deterioration due to improper handling or care is not covered under warranty.

Limited Liability: The artist and gallery is not liable for any indirect, consequential, or incidental damages resulting from the purchase or use of artwork.

Changes to Terms:

These terms and conditions may be updated from time to time, and the most recent version will be applicable to all future transactions.

Governing Law: These terms and any disputes will be governed by and interpreted in accordance with the laws of England.

Severability: If any part of these terms is found to be unenforceable, the remaining provisions will still apply.

Distant Selling Regulations

Introduction:

This return policy is designed to comply with the Distant Selling Regulations in the UK and ensures transparency and fairness in all transactions with our customers.

It applies to all purchases made through our online art gallery or by telephone, email and SMS direct from the gallery.

Right to Cancel:

Customers have the right to cancel their order within 14 days of receiving the artwork without giving any reason.

Notification of Cancellation:

To exercise the right to cancel, customers must inform us of their decision to cancel the order by a clear statement. This can be done via email or written communication. Also provide proof of purchase.

Return Process:

Once cancellation is confirmed, the customer must return the artwork within 14 days from the date of cancellation. Please contact the gallery before shipping so we can arrange to be open to receive it.

Return Shipping:

The customer is responsible for the cost of return shipping unless the product is faulty or not as described.

Condition of Returned Artwork:

Artwork must be returned in the same condition it was received, with original packaging where possible. We reserve the right to refuse returns that do not meet these conditions.

Refund:

We will process a full refund within 14 days of receiving the returned artwork by original payment method. We may withhold the refund until we have received the artwork or proof of return.

Deductions:

We reserve the right to deduct from the refund if the artwork is damaged or not in its original condition. e.g. damaged frame, broken glass, scuffs, scrapes to artwork or frame.

Exemptions:

Certain types of artwork and items, such as personalised or custom-made pieces, custom framed artwork and products cut or made to your specification may not be eligible for return unless they are faulty.

Faulty Artwork:

If the artwork is found to be faulty, we will arrange for the return and offer a full refund or a replacement artwork.

Selling Art to us:

Robert Perera Fine Art Ltd reserves the right to refuse to give valuations and purchase items.

The client owns the object or has the authority of the owner to sell the object.

It is wholly owned and is not subject to any outstanding finance agreement, claims or any restrictions etc.

Unless you say otherwise we can share your photos and information with our clients and partners and you give us permission to use them for our records, research and website. You grant Robert Perera Fine Art Ltd. a royalty free licence, in perpetuity, to use the photographs you supply.

We may pass your details onto trusted interested parties only in connection with the sale of your item.

As part of our due diligence you give us permission to check your items with the Fine Art Loss Register.

Payment will be by cheque or bank payment. It is our company policy that we do not pay cash for any transaction.

All valuations are our personal opinion of what the item is worth to us based on information given to us by you including photos and descriptions and are subject to seeing the item. Any valuation given is not intended for and must not be used or any other purpose.

The client will disclose all relevant commercial history of the items including auction history.

The buying price (valuation) cannot be used as a valuation for insurance or any legal or official purpose.

Robert Perera Fine Art Ltd. shall only be responsible for goods when they are at our gallery and only for what is covered by our insurance policy.

Robert Perera Fine Art Ltd are not responsible for advice or actions of recommended parties and have no responsibility for any loss or damages however caused.

In the event that purchased items are proved to be fakes or have defective title the seller agrees to refund Robert Perera Fine Art Ltd. in full.

If we introduce you to one of our trusted partners, for you to deal with directly, we may receive an introductory comission from our partner. We do not act as an agent.

Should there be a dispute both parties agree exclusive use of the English courts.
